Under this rapid changes it become necessary for every business to be updated with the continuous changes of Taxes. There are so many taxes where VAT indirect tax have various categories itself: –
- Taxable VAT
- Zero Rated VAT
- No VAT
- Partially Exempt VAT
Let’s Discuss the PARTIALLY EXEMPT VAT
It is the combination of PARTIAL and EXEMPT.
We start with Exempt: -Those goods and services which are not subject to VAT or an organisation is not eligible to VAT due to its goods and services are not covered in tax is known as Exempt.
Whereas partially exempt VAT in which goods and services are exempt on purchases and expenses up to some proportions as provision applied.
There are various business houses where partially exempt VAT applied.
- Financial
- Real Estate
- Education
- HealthCare
- Charitable
- Postal
- Cultural
- Certain Sports and physical Education
But this information is incomplete untill we haven’t get about upto the limit of exemption and taxed portion.Under UK Law DE MINIMIS is provision is applicable for business.
(a) One million of taxable supplies of goods and services
or
(b) If your exempt supplies are less than £250000 million (5% of the total supplies, whichever is lower) you can claim VAT.
How to calculate the exemption of VAT with an example: –
STEP:-1 Calculate the Total Supplies
Total Taxable Supplies: – £250000
Total Exempt Supplies: £300000
Total Supplies: –
Total Taxable Supplies + Total Exempt Supplies = £250000 + £300000 = £550000
(b) Step 2. Determine the Input Vat Paid on Taxable and Exempt VAT
Let’s take It around :- £60000
(c ) Step 3. Calculate Proportion of Taxable Supplies
Proportion = Value of taxable sales / Total Supplies = £250000 / £550000 = £.4545
1. Apply the Proportion to Input VAT
Reclaimable VAT = Total input VAT × Proportion of taxable supplies £60000 * £.4545 = £27272
Or
Total Taxable Supplies: £800,000
Total Exempt Supplies: £30,000
Total Supplies: £830,000
5% of Total Supplies = £41500
Since £30,000 < £41500, you can reclaim all input VAT.
Here is another rule of 5% and £1875 rule.
The 5% rule and the £1,875 rule are individual provisions under the Partial Exemption rules. We can use that interchangeably but cannot combine with each other to claim VAT
Individual Application
1. 5% Rule:
- If the value of your exempt supplies is less than 5% of your total supplies, you can reclaim all input VAT. This rule applies regardless of the amount of input VAT attributable to exempt supplies.
2. £1,875 Rule:
- If the input VAT attributable to exempt supplies is less than £1,875 per year, you can also reclaim all input VAT. This rule applies regardless of the proportion of exempt supplies.
Choosing Which Rule to Apply
- You should evaluate both rules individually to see which one applies to your situation.
- If you qualify under both, you can reclaim all input VAT based on either rule. However, you don’t combine the two rules to establish a new threshold.
- Example: – Scenario for the 5% Rule:
Total Taxable Supplies: £800,000
Total Exempt Supplies: £30,000
Total Supplies: £830,000
5% of Total Supplies = £41500
Since £30,000 < £41500, you can reclaim all input VAT.
2. Example: – Scenario for the £1,875 Rule:
- Total Input VAT from Exempt Supplies: £1500
- Since £1,500 < £1,875, you can reclaim all input VAT.
